Preamble
QUALITRAVEL CESTOVNÁ AGENTÚRA s.r.o. carries out business primarily in the intermediation of air transport services, including the sale of flight tickets. To provide its services properly, the Company issues these general terms and conditions governing its relationships with customers and the provision of services through www.qualitravel.sk.
Article I. Definitions
For these general terms and conditions and the business relationship between the Company and its customers, the following definitions apply:
- QualiTravel: QUALITRAVEL CESTOVNÁ AGENTÚRA s.r.o., Struková 13, 821 05 Bratislava, company ID 35 901 578, registered in the Commercial Register of the Bratislava I District Court, section Sro, file 33276/B.
- Terms: these general terms and conditions.
- Intermediation of air transport services, including ticket sales: all activities enabling a customer who requests a service from QualiTravel to enter into an air transport contract with the selected airline through a registered system on the publicly accessible internet.
- Reservation: an entry about the customer in a global reservation system and the relevant carrier’s system, made through www.qualitravel.sk, registering the customer and persons they designate as entitled to transport between specified places at a specified time under the carrier’s conditions. The registered information includes the customer’s and passengers’ first names, surnames, gender and, for certain categories or where required by the carrier, dates of birth, particularly for children, young passengers within the age limits set by the airline, and students. The reservation also contains the exact times and places of the itinerary, airline and flight details and, where the carrier’s conditions allow, special requests concerning meals, drinks, health difficulties and seat reservations.
- Ticket: evidence of a contract entitling the customer to transport of persons and baggage from the requested departure point to the destination, and entitling the airline to the agreed payment. QualiTravel intermediates the contract through www.qualitravel.sk, where the service is ordered and confirmed. Payment of the agreed ticket price concludes the transport contract with the carrier and signifies acceptance of that carrier’s conditions of carriage. General conditions of carriage for IATA members are included in the appendix to these Terms. QualiTravel acts as an intermediary; all transport conditions arise exclusively from the agreement between the customer and the airline and its general conditions of carriage. QualiTravel therefore accepts no responsibility for deficiencies in the carrier’s services. The customer must address related claims directly to the carrier.
- Ticket in the form of electronic confirmation: confirmation of the contract sent over the internet to the customer’s designated email address. It represents a record in the airline’s electronic system containing all agreed transport conditions, subject to the necessary data security and protection. We recommend carrying this confirmation to demonstrate entitlement to transport at airport check-in. Confirmation may also be emailed automatically from another website.
- Ticket price: the price agreed by the parties for air transport services. Each airline’s conditions determine what the price includes and which charges it excludes.
- Airport charges: charges collected by a city, state or country at the departure point. They are usually collected with the fare, except where payable directly at the airport, particularly in certain countries in Asia, Africa and South America.
Article II. Reservation conditions and procedure
QualiTravel operates the website www.qualitravel.sk in accordance with legal regulations. Customers can use its online reservation system to search for flights, departure and arrival times, prices and other conditions relating to a flight and its operating airline. Customers can enter basic flight criteria in the reservation form, including departure and arrival points, departure date, return departure point and return date.
After finding a suitable connection with available seats, the customer can reserve it electronically. The system generates a reservation code and emails confirmation to the address the customer provides. The customer must check the reservation at www.viewtrip.com, entering the exact code in “Reservation #” and their surname, or the relevant passenger’s surname, in “Last Name”.
If the customer discovers any discrepancy, they must immediately contact QualiTravel by email or telephone and provide all relevant facts. A discrepancy includes any incorrect entry, however small, including incorrect first names or surnames, or names entered in the wrong fields. If the customer fails to check the reservation, QualiTravel accepts no liability for resulting losses and the customer may not bring claims against QualiTravel on that basis.
If the customer does not pay by the due date stated on the invoice, the reservation expires because of a material and serious breach of the customer’s contractual obligations. The system automatically cancels it without entitlement to compensation or reimbursement of costs.
The ticket price confirmed by the system at the end of the reservation is agreed only until the invoice due date. The carrier may nevertheless change the price. QualiTravel reserves the right to refuse to issue a ticket where a system error or a carrier’s price change prevents issuance at the invoiced price. In that case, the customer must request a refund by emailing letenky@qualitravel.sk with the reservation code, invoice number and account number for repayment, less the charges specified in these Terms.
If the customer does not receive electronic ticket confirmation by email within 24 hours after the full invoiced amount reaches QualiTravel’s account, they must immediately contact its call centre on 0905 535 190 on working days between 09:00 and 17:00.
The customer is responsible for entering complete, correct and truthful information about themselves and all other passengers they designate. This information identifies the customer, other passengers and the reservation. If the airline requires additional information or documents to issue a ticket, such as a passport or ID number, a Miles & More card number, an ID copy or a credit card number, the customer will be notified by telephone or at the supplied email address.
QualiTravel is not obliged to fulfil its obligations and reserves the right not to issue the requested service document if the customer fails to supply the required documents, supplies them late, or supplies documents that are defective, incorrect or illegible. In that case, the customer has no entitlement to claims against QualiTravel or compensation for loss resulting from non-performance.
By entering the information and completing the reservation, the customer consents to the processing of their own and the other named persons’ personal data for ticket issuance. If information is false, incorrect or incomplete, QualiTravel may immediately cancel the reservation, adjust the price or seek compensation for any resulting loss.
Reservations can be amended, changed or cancelled without charge before payment. Once the ticket is issued, all changes and cancellations are subject to the applicable airline fare conditions. The customer must obtain and review those conditions before paying and before ticket issuance.
QualiTravel charges an administration fee for changes to issued tickets. When issued tickets are cancelled, the non-refundable ticket issuance fee is retained and an administration fee is charged for each ticket, including all low-cost airline tickets. This fee also applies when the customer requests only airport charges back on a non-refundable ticket, or cancels a ticket whose flights the airline has changed or cancelled. These fees are additional to the airline’s charges.
To cancel a ticket paid by credit card, the customer must enter the card details on the cancellation form, thereby authorising QualiTravel to deduct the cancellation administration fee. For tickets paid by credit card, the carrier refunds the total amount, less its cancellation charge, directly to the account associated with the card used for payment.
Passenger names cannot be changed on an individual reservation, except with certain airlines, particularly low-cost carriers, that allow changes for a fee. Where a change is not possible, the customer can only make a new reservation at current prices and subject to current availability.
If a ticket is cancelled on the date of issuance, payment is returned to the customer’s account. By accepting these Terms, the customer agrees to this procedure.
By entering their details, completing the reservation and selecting agreement with these Terms, the customer declares that they have read and understood them and accept them in full.
Article III. General provisions
Delivery
Tickets and other documents are issued and sent immediately after payment of the invoice for the ordered service. Payment means that the full invoiced amount for the agreed service and all related services, accounting for any discounts, reaches QualiTravel’s account by the invoice due date.
Delivery takes place exclusively by the agreed method: electronic tickets are emailed to the address the customer provides. The system automatically checks whether an electronic ticket can be issued. The ticket and itinerary are sent only to the address entered during reservation. The customer can print the electronic ticket confirmation from the email or from the “Electronic Ticket Receipt” section of www.viewtrip.com.
Other products and related documents are normally sent by email, unless QualiTravel chooses postal delivery. QualiTravel accepts no responsibility for the carrier’s actions, flights cancelled by the airline or changed departure times.
Payment for services
The customer acknowledges that tickets can be paid for in the following ways:
- Bank transfer. QualiTravel issues an automatically generated advance invoice and delivers it as agreed. It is also included in the reservation confirmation email. The customer may pay into any QualiTravel account stated on the invoice. To speed up payment, QualiTravel recommends using its account at the same bank as the customer.
- Direct deposit into QualiTravel’s account. This method is required if the reservation confirmation form states that payment must be made within 24 hours of confirmation. Otherwise, the reservation is cancelled.
- Other methods offered by individual banks, such as VÚB payment, Sporopay or TatraPay.
- Credit card, through the interface at www.qualitravel.sk during reservation or afterwards. QualiTravel accepts no liability for complaints concerning misuse of the card and will recover the full loss from the customer.
Credit card payment may be split across several transactions. The ticket price, airport charges and all or part of other product prices may be charged directly by the airline or another service provider. Ticket issuance fees, courier delivery charges and part of other product prices may be charged separately. If a transaction cannot be completed, the customer will be notified by telephone and must pay the amount into one of QualiTravel’s accounts that same day under the following payment conditions. Otherwise, the flight reservation is cancelled without entitlement to compensation.
The customer must pay correctly and on time, according to the invoice due date. An invoice is paid when the full amount reaches any QualiTravel account stated on it. The full amount must arrive by 17:00 on a working day, Monday to Friday. If it arrives later, QualiTravel reserves the right to change the price under the airline’s fare conditions or the conditions of other service providers, particularly air carriers.
If the due date is missed, QualiTravel may immediately cancel the reservation without any entitlement to compensation for resulting loss, or change the price of the ticket or other services. A refund following failure to meet these payment conditions, late payment or partial payment is subject to an administration fee. An administration fee also applies to refunds of overpayments.
The customer must enter the invoice number as the payment reference (“variabilný symbol”). Failure to enter the correct reference is treated as non-payment, with all associated consequences. The customer agrees to receiving invoices by email and to their agreed format. For ticket sales, payments received by QualiTravel are applied first to ancillary amounts due and then to the ticket price.
Personal data
By accepting these Terms, the customer consents to QUALITRAVEL CESTOVNÁ AGENTÚRA s.r.o. processing their first name, surname, address, email, telephone number, date of birth and gender to register their personal data in connection with ticket reservations. The customer also consents to processing for one year. They declare that, with the relevant third party’s consent, they are authorised to provide that person’s personal data to the same extent and for the same purpose.
The customer consents to cross-border transfers of their personal data solely to issue their ticket, to the airline or association of carriers operating the reserved flight, other service providers and QualiTravel’s contractual partners.
The customer declares that all information provided is truthful and acknowledges the consequences of providing false information, particularly that this may constitute a criminal offence. The customer authorises QualiTravel to verify the supplied credit card information with the relevant call centre of the issuing bank or company.
Customer declarations
For any service involving the intermediation or arrangement of air transport, the customer confirms that they have read and unconditionally accept the airlines’ general conditions set out in the appendix. The customer acknowledges that QualiTravel accepts no responsibility for matters relating to the reserved flight, such as delays, cancellations or lost baggage. The airline concerned is responsible for resolving discrepancies and complaints about the flight.
The customer agrees that QualiTravel may record incoming and outgoing calls for internal purposes and to improve service quality.
Complaints
QualiTravel is responsible for providing the customer, in its capacity as intermediary, the opportunity to reserve their chosen flight through www.qualitravel.sk. QualiTravel is not liable in the cases set out in these Terms, where the airline is directly responsible, or where the customer’s action, omission or other conduct causes the loss.
If the customer meets all requirements for completing the reservation form and can prove this precisely and unambiguously, but no reservation is made, they may immediately submit a written complaint to the Company’s registered address and, at the same time, to letenky@qualitravel.sk, explaining the reasons.
QualiTravel handles complaints without delay where operationally possible and no later than 30 days after receipt by post at its registered office or by email at letenky@qualitravel.sk. Within that period, it informs the customer whether it considers the complaint justified and well-founded.
If the complaint is justified, QualiTravel undertakes, at its own expense, all steps necessary to enable the customer to conclude a transport contract with their chosen airline and purchase a ticket under the conditions originally sought. If that is not possible, QualiTravel takes all steps to enable a contract under similar conditions, particularly regarding times, departure and arrival points, and price.
Final provisions
Documents between the customer and QualiTravel are delivered electronically to the supplied email address or by post. An emailed document is deemed delivered if QualiTravel does not receive a delivery failure notification. If the customer does not accept postal correspondence, it is deemed delivered on the third day after dispatch.
Visa requirements and travel documents. The customer must check travel documents and visa requirements for both the destination and transit points. QualiTravel provides information on entry requirements and documents on request. The customer can also find information at www.mzv.sk. QualiTravel is not responsible for losses caused by the customer’s lack of information about visa requirements.
Appendix: General conditions of carriage of IATA member airlines
Notice
For carriage where the final destination or a stop is in a country other than the country of departure, the Warsaw Convention applies. In most cases it limits the carrier’s liability for death or personal injury and for loss of or damage to baggage.
Conditions of contract
- “Ticket” means the passenger ticket and baggage check, including these conditions and notices. “Carrier” means all air carriers that carry or undertake to carry the passenger or baggage under this ticket, or provide related services. “Warsaw Convention” means the Convention for the Unification of Certain Rules Relating to International Carriage by Air, signed in Warsaw on 12 October 1929, or that Convention as amended by the Hague Protocol of 28 September 1955, whichever applies.
- Carriage under this ticket is subject to the liability rules and limits of the Warsaw Convention, except where it is not “international carriage” as defined by that Convention.
- To the extent consistent with the foregoing, each carrier’s transport and other services are subject to the ticket provisions, applicable tariffs, and the carrier’s conditions of carriage and related regulations incorporated into them, available on request at carrier offices. Exceptions apply to carriage between the United States or Canada and a place outside those territories, for which tariffs in force in those countries apply.
- The carrier’s name may be abbreviated on the ticket. Its full name and abbreviation appear in its tariffs, conditions, regulations or timetables. Its address is the departure airport shown beside the first abbreviation of its name on the ticket. Agreed stopping places are those stated on the ticket or shown in the carrier’s timetables as scheduled stops on the passenger’s route. Successive carriage by several carriers under this ticket is considered one operation.
- A carrier issuing a ticket for transport on another carrier’s routes acts only as that carrier’s agent.
- Any exclusion or limit of carrier liability applies to and benefits its agents, employees and representatives, any person whose aircraft it uses, and that person’s agents, employees and representatives.
- Checked baggage is delivered to the bearer of the baggage check. Damage to baggage in international carriage must be reported to the carrier in writing immediately after discovery and no later than seven days after receipt. Delay complaints must be submitted no later than 21 days after baggage delivery. For domestic carriage, consult the tariffs or conditions of carriage.
- The ticket is valid for transport for one year from issuance unless the ticket, carrier’s tariffs, conditions or regulations state otherwise. The fare is subject to change before carriage begins. The carrier may refuse transport if the applicable fare has not been paid.
- The carrier undertakes to use its best efforts to carry passengers and baggage as quickly as possible. Times shown in timetables or elsewhere are not guaranteed and do not form part of this contract. Without notice, the carrier may substitute other carriers or aircraft and, when necessary, alter or omit stopping places. Schedules may change without notice. The carrier is not responsible for making connections.
- The passenger must comply with government travel requirements, present exit, entry and other required documents, and arrive at the airport by the carrier’s specified time or, if none is specified, early enough to complete departure formalities.
- No agent, employee or representative of the carrier may alter, modify or waive any provision of this contract.
- Flights must be used in the exact order issued. If a passenger does not take any flight segment, the carrier may immediately cancel subsequent segments without compensation for resulting loss. This restriction does not apply to certain low-cost carriers, which generally allow passengers to miss the first flight and take a later one. We recommend asking QualiTravel’s call centre on 0905 535 190 about the specific reservation.
- The carrier reserves the right to refuse transport to anyone who obtained a ticket in breach of applicable laws, tariffs, rules or regulations of the carrier named in the “Issued by” field on the front of the passenger ticket and baggage check, which is subject to tariff regulations.
- For double or duplicate reservations, the airline may cancel without compensation for resulting loss. This includes reservations processed by QualiTravel or another travel agency or tour operator. QualiTravel accepts no responsibility for related complications or compensation.
Advice to international passengers on limitation of liability
Passengers whose journey involves a final destination or stop in a country other than the country of origin are advised that the Warsaw Convention may apply to the entire journey, including portions wholly within the country of origin or destination.
For passengers travelling to, from or with an agreed stop in the United States, the Convention and special contracts of carriage included in applicable tariffs provide that the liability of certain carriers party to those contracts for death or personal injury is, in most cases of proven damage, limited to US$75,000 per passenger. Liability up to that limit does not depend on the carrier’s negligence.
For passengers travelling with a carrier not party to those contracts, or whose journey does not include the United States as a departure point, destination or agreed stop, liability for death or personal injury is generally limited to approximately US$10,000 or US$20,000. The names of carriers party to special contracts are available at their ticket offices for inspection on request.
Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by the carrier’s liability limits under the Warsaw Convention or special contracts. For more information, contact the airline or insurance company.
Note: the US$75,000 liability limit includes legal fees and costs, except where a claim is brought in a state providing for a separate award of legal fees and costs. In that case, the limit is US$58,000 excluding legal fees and costs.
Government-imposed taxes and charges
The ticket price may include taxes and charges imposed by government authorities on air transport. These may represent a substantial portion of the fare and are either included in it or shown separately in the “TAX/FEE/CHARGE” fields. Passengers may also be asked to pay taxes and charges that have not yet been collected.
The following notice does not apply to tickets sold in the United States for carriage originating there.
Denied boarding due to overbooking
In countries where denied boarding compensation regulations apply, carriers operate compensation schemes for passengers with confirmed reservations who are denied boarding because overbooking leaves no seat available. Further details are available at airline offices.
Check-in times
Times shown on the ticket or itinerary are aircraft departure times. Check-in times specified by the carrier or timetable are the latest times at which passengers can be accepted for travel, allowing time for all necessary formalities. Flights cannot be delayed for passengers arriving late, and no liability is accepted in such cases.
Prohibited articles
For safety reasons, the following dangerous articles must not be carried in passenger baggage:
- Compressed gases, including deeply refrigerated, flammable, non-flammable and poisonous gases, such as propane-butane, liquid nitrogen, oxygen and diving cylinders.
- Corrosives, including acids, alkalis, wet batteries and mercury.
- Explosives, ammunition and pyrotechnic material.
- Flammable liquids and solids, including lighters, lighter refills, matches, paints and thinners.
- Radioactive material.
- Security boxes and briefcases with installed security devices.
- Oxidising agents, including bleaching powder and peroxides.
- Poisons and infectious substances, including insecticides, herbicides and live viral material.
- Other dangerous articles, including magnetic material and irritating or offensive substances.
Medicines and toiletries, such as hairspray, perfume and medicines containing alcohol, may be carried in limited quantities necessary and appropriate for the flight’s duration. Many of the articles listed above can be transported as air cargo if their packaging complies with air cargo regulations.
